General Information
This document outlines the rules for processing and protecting the personal data of individuals visiting the ener.pl website (hereinafter referred to as the “Website”) and filling out the contact form available on the Website (hereinafter referred to as the “User”). In order to ensure the security of the entrusted data, we have developed internal procedures and guidelines designed to prevent data from being disclosed to unauthorized persons. We monitor their implementation and continuously verify their compliance with applicable legal acts, including the Data Protection Act, the Act on the Provision of Electronic Services, as well as various executive acts and EU regulations. The Administrator of personal data, as defined by the provisions of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter referred to as “GDPR”), as well as the entity using cookies, is the company Ener Polska sp. z o.o. with headquarters in Warsaw (ul. Scope and Purpose of Collected Data and Processing Time
This Privacy Policy applies to the personal data of Users collected for the following purposes:
- Establishing contact with the User (based on Article 6(1)(a) of GDPR – the User’s consent initiated by contacting us);
- Creating reports and analyses for the Administrator regarding the operation of the Website, including page view statistics, particularly of articles published on the Website (based on Article 6(1)(f) of GDPR);
- Customizing the content of the Website to the User’s preferences and optimizing the User’s experience, especially by recognizing the User’s device (based on Article 6(1)(f) of GDPR).
To establish contact with the User, the Administrator collects the following data: first name, last name/company name, email address, phone number, and the content of the inquiry (in the form of an email or inquiry submitted via the contact form or the land verification form available on the Website). The Administrator declares that providing the data mentioned in point 2 above is voluntary but necessary to enable contact with the User. The User’s personal data will be processed for the period necessary to achieve the purposes for which the data was collected. The Administrator informs that while using the Website, data concerning the User is also collected automatically. This data may be collected in the Website’s system logs through cookies (the cookie policy can be found HERE).
Administrator’s Rights and Responsibilities
The Administrator reserves the right to disclose selected information about the User to the relevant authorities or third parties who request such information based on a proper legal basis, in accordance with applicable law. The Administrator declares that the processing of the User’s personal data or other data referred to in the Privacy Policy is entrusted, based on written agreements in accordance with Article 28 of GDPR, to entities providing hosting services and real estate sales offices on behalf of the Administrator. The personal data of Users will be processed for the period necessary to achieve the purposes for which they were collected.
User’s Rights and Responsibilities
The Administrator informs that in connection with the processing of personal data, each User has the following rights under GDPR:
- The right to access their data and receive a copy of it;
- The right to rectify their data;
- The right to delete data (“Right to be Forgotten”);
- The right to restrict processing;
- The right to object to processing;
- The right to data portability;
- The right to withdraw consent at any time, if the data is processed based on consent;
- The right to lodge a complaint with the supervisory authority, i.e., the President of the Personal Data Protection Office, if they believe that the Administrator is processing data in violation of the law.
To exercise the rights mentioned in paragraph 1 above, please send an email to kontakt@ener.pl with the subject line: “Personal Data.” If the Administrator requests consent to send commercial information electronically (e.g., via email, SMS, etc.), the User has the right to withdraw this consent. To do so, please send an email to kontakt@ener.pl with the subject line “Opt-out.” If the User includes any personal data of other individuals (such as their name, address, phone number, or email address) in the Website’s contact form, they may do so only if it does not violate applicable law or the personal rights of those individuals.
Supplementary Information
- We inform you that the Administrator will not make automated decisions based on the User’s personal data.
- Personal data will not be transferred outside the European Economic Area.
- The Website may contain links to other websites. These websites operate independently of ener.pl and are not supervised in any way by ener.pl. These websites may have their own privacy policies and regulations, which we recommend reviewing.
